Utilizing Geolocation Data to Prove Demand Letter Delivery

An essential element of mortgage foreclosure litigation is proving the satisfaction of all conditions precedent, specifically, proving that a lender sent a demand letter in accordance with the terms of the mortgage. The mortgage usually contains a provision stating that the demand letter will be deemed to have been sent to the borrower when mailed by first class mail to the borrower’s notice address. This presumption of delivery often overcomes one of the most common affirmative defenses advanced by borrowers. Unfortunately for lenders, sometimes a mistake made years prior can negate this presumption and force the lender to prove that the letter was actually delivered to the borrower.
